1. Scope, operator and acceptance
1.1 These Terms of Use govern your use of the website at digitaleast.mobi and any sub-domain operated by Digital East GmbH (“Digital East”, “we”, “us”). They do not govern use of the DE demand-side platform itself. Access to the platform is granted only under a signed Master Services Agreement; where these Terms and that agreement differ, the Master Services Agreement prevails for platform use.

1.3 By using this website you accept these Terms in the version published at the time of your visit. If you do not accept them, please do not use the website.
1.4 The website is directed at businesses. Nothing on it is an offer capable of acceptance, and no contract for services arises from the website alone. Information about our services, formats, reach or performance is non-binding and may change without notice.
1.5 These Terms are general terms and conditions within the meaning of §§ 305 et seq. BGB. Any terms of your own do not become part of this relationship, even if we do not object to them separately.
2. Use of the website
2.1 You may view the website and download or print individual pages for your own business use.
2.2 You must not:
- use the website in breach of applicable law or third-party rights;
- introduce malware, attempt to gain unauthorised access, or test, scan or probe the website or our systems for vulnerabilities;
- use automated means to crawl, scrape or copy the website beyond ordinary search-engine indexing;
- place excessive load on the website or interfere with its operation; or
- misrepresent your identity or your authority to act for a company.
2.3 Account request form. The website lets you request access to the DE demand-side platform. Submitting the form is a request only. It creates no entitlement to access. Access begins when a Master Services Agreement and the data processing agreement attached to it have been concluded and we have issued access credentials.
2.4 You must give accurate information in any form on the website and keep any credentials we issue confidential. Actions taken using your credentials are attributed to you unless you show that you are not responsible for their use.
2.5 We may block access to the website, in whole or in part, where this is necessary to protect the website, our systems or third parties, or where you breach clause 2.2.
2.6 The website is aimed at businesses, not consumers. You confirm that you use it in the course of your trade, business or profession.
3. Content, intellectual property and links
3.1 The website and its content — text, graphics, layout, logos, software and the “Digital East”, “DE” and “DESSY” names and marks — are protected by copyright and trade mark law and belong to Digital East or its licensors. Clause 2.1 aside, no rights are granted to you.
3.2 You may link to the website. You may not frame it, present it as your own, or use our marks in a way that suggests a partnership, endorsement or approval that does not exist.
3.3 Where the website carries content supplied by third parties, that content remains theirs.
3.4 The website links to sites we do not operate. We have no control over them and adopt none of their content. We check linked pages for obvious unlawfulness when the link is set, but have no duty to monitor them afterwards. If you tell us a linked page is unlawful, we will remove the link promptly.
3.5 Any feedback or suggestions you send us about our services may be used by us without restriction and without payment.
4. Availability, warranties and liability
4.1 The website is provided free of charge. We do not warrant that it will be available without interruption or free of errors, and we may change, suspend or discontinue it at any time.
4.2 Information on the website is provided for general guidance. We take care that it is accurate when published but do not warrant that it is complete, current or fit for any particular purpose.
4.3 We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Produkthaftungsgesetz, and to the extent we have given a guarantee.
4.4 For ordinary negligence we are liable only where we breach a material contractual obligation — an obligation whose performance makes proper use of the website possible in the first place and on whose performance you may reasonably rely — and then only for foreseeable damage typical of this kind of agreement.
4.5 Any further liability is excluded. This applies equally to the personal liability of our legal representatives, employees and agents.
4.6 Clauses 4.3 to 4.5 do not affect liability under the GDPR, which is governed by Art. 82 GDPR.
5. Privacy and cookies
5.1 How we handle personal data is described in our Privacy Policy at https://www.digitaleast.mobi/privacy-policy/, which forms no part of these Terms and is not a contractual undertaking.
5.2 Cookies strictly necessary for the website to work are set without consent. All others, including analytics, are set only after you consent through the banner shown on your first visit. You can change or withdraw that choice at any time through the cookie settings link on the website. Continuing to browse is not treated as consent.
5.3 Our consent management platform is Cookiebot (Usercentrics A/S, Denmark).
5.4 If you receive advertising delivered through our platform, your choices are collected by the website or app you are using and reach us as a consent signal. The website cookie banner does not control that, and these Terms do not govern it. Part B of our Privacy Policy explains how it works.
6. Changes, governing law and general
6.1 We may amend these Terms at any time with effect for the future. The version published on the website when you visit applies. Changes do not affect contracts already concluded; those are governed by the Master Services Agreement.
6.2 German law applies, excluding the UN Convention on Contracts for the International Sale of Goods and German conflict-of-laws rules.
6.3 Where you are a merchant, a legal person under public law or a special fund under public law, the exclusive place of jurisdiction is Hamburg. We may also sue you at your general place of jurisdiction.
6.4 We are not obliged and not willing to take part in dispute resolution proceedings before a consumer arbitration body.
6.5 If any provision of these Terms is or becomes invalid, the remainder stays in force.
6.6 These Terms are published in English. Where a German version is also published, the English version prevails.
